This is an academic research book that systematically investigates the unique Buraku discrimination in Japan from the perspective of public law, especially modern constitutional law, for the first time in Japan. It outlines the historical background to clarify the uniqueness of Buraku discrimination, identifies current issues, organizes and summarizes the few existing research, examines interpretative issues, and then clarifies the legal problems arising from them, considering and examining the interpretation principles of Article 14 and Article 13 of the Constitution. In recent years, there have been various legislative examples in various countries that concretize the demands of legal policy with the aim of realizing substantive equality, such as affirmative action in the United States, as a measure to eliminate discrimination against historically discriminated minorities. This book also comprehensively compares and examines the development of case law related to affirmative action.
